#2 - Delivery of products
Dutch consumer law applies to all of our deliveries.
This determines the legal rights and obligations of the buyer and/or seller with regards to
the purchasing of our products: warranty, cooling-off periods, payments, returns, etc.
#3 – Special offers
If there are any special offers or (web)promotions, all conditions will be clearly stated on our
website.
We reserve the right to adjust any offers.
Offers extended during a purchase will naturally be honoured.
#4 – Purchase agreement
The purchase agreement takes effect from the moment a consumer has placed an order.
Purchases made via our website are legally binding and not refundable when Crystal Fresh
has confirmed the order.
#5 – Right of withdrawal (cooling-off period)
The consumer has the right to cancel an order for up to 14 days after purchase
In order to cancel a purchase, the consumer must within the specified period of 14 days
inform Crystal Fresh by e-mail or letter.
The products must then be returned to Crystal Fresh in good condition and at the
consumer’s own expense. Refunds will be processed within 4 working days after receipt of
the returned goods.
Some products, where this is clearly stated, are not refundable.
#6 – Price
The price of our products cannot be changed within the validity period as set out by Crystal
Fresh.
This excludes legally required price changes, such as a change in the VAT rate.
All prices as stated on our website include 21% VAT, but exclude any handling costs. Our
handling costs can be found on our website.
We accept no liability for any printing or typographical errors on our prices. In this special
and unforeseen case, we will not be delivering the products.
#7 – Warranty
Crystal Fresh guarantees that all of its products comply with all legal standards and
regulations, and that its products are therefore safe to use
Not ordered, incorrectly delivered and/or defective products can be returned by the
customer free of charge within two weeks of receipt, provided that the consumer reports
this in writing or by e-mail to Crystal Fresh within two weeks of purchase.
It goes without saying that the above mentioned products will only be credited if they are
offered back to us in their original packaging and have not been used.
Refunds will be processed within 4 working days of receipt of the goods.
#8 – Payments / transactions
Ordered goods must be paid for by the customer as soon as possible, but no later than 14
days after the order date (i.e. within the statutory cooling-off period)
The consumer bears all responsibility for providing the correct bank and address details.
In the event that the consumer/buyer does not pay within the agreed term, we reserve the
right to charge any legally determined costs.
#9 – Delivery
Crystal Fresh will process orders accurately.
Our deliveries are based on the information provided by the consumer (address/bank
details/etc.)
We aim to process orders within 24 hours and to deliver products within 14 days.
In the event that we cannot meet this promise, or if otherwise jointly agreed, the consumer
has the right to cancel the order without additional costs after the 14-day period.
In the event of a delayed delivery, or if a delivery can (temporarily) not be honoured in full,
the consumer will be notified within 14 days. In this case, the consumer has the right to
cancel the ordered goods without additional costs.
Crystal Fresh bears responsibility for the proper delivery of the ordered goods. Goods not
delivered, incorrectly delivered or damaged will be replaced free of charge.
#10 – Complaints Procedure and Disputes
Complains regard delivered products, the delivery and handling of the agreement must be
lodged in a clear way and within 7 days (by e-mail or in writing) with Crystal Fresh. Crystal
Fresh will respond within 14 days of receiving a complaint.
Complaints that require a longer processing time will receive an answer within 31 days.
In all cases, Crystal Fresh will inform the complainant about the procedure and progress of
the complaint(s).
If a complaint is well-founded, Crystal Fresh will – in consultation with the consumer –
proceed to refund and/or replace the delivered products free or charge.
Any agreements made between Crystal Fresh and its consumers are subject to Dutch law,
even if the consumer does not reside in the Netherlands. Therefore, the Vienna Sales
Convention does not apply.
